TERMS & CONDITIONS

  1. This accompanying Service Proposal and these Terms and Conditions constitute the entire contract (Agreement) between you (the Customer) and Premier Pressure Solutions WA (Premier Pressure Solutions).

  2. These Terms and Conditions apply to the exclusion of all others, including any terms proposed by the Customer that are contrary to or inconsistent with these Terms and Conditions. No variation, modification or substitution of these Terms shall be binding on Premier Pressure Solutions unless accepted in writing.

  3. “Customer” or “You” means the person, trust, firm, company, partnership, or other entity that requests cleaning and associated services from Premier Pressure Solutions.

  4. Subject to the terms of this Agreement, Premier Pressure Solutions will provide cleaning services (the Service) to the Customer at the address specified by the Customer (the Premises).

  5. The Service will include such pressure cleaning, soft washing, disinfecting, surface cleaning and associated services as agreed with the Customer.

  6. Premier Pressure Solutions reserves the right, at its sole discretion, to accept or reject any request for Services.

  7. Use of the Services constitutes acceptance of this Agreement.

  8. Premier Pressure Solutions will endeavour to provide the Services in a timely and professional manner.

  9. The Customer acknowledges that no employee, agent, contractor or representative of Premier Pressure Solutions has authority to make any representation, warranty or promise inconsistent with these Terms.

  10. The Customer represents and warrants that:
    a. A safe working environment and unobstructed access to the Premises will be provided for the performance of the Services;
    b. Access to all necessary utilities, including water and power, will be supplied at no cost;
    c. Any known or suspected hazards present at the Premises will be disclosed prior to commencement of the Services;
    d. The Customer is legally entitled to authorise access to the Premises;
    e. All applicable work health and safety obligations under Western Australian legislation have been complied with;
    f. All fragile, delicate or valuable items will be secured or removed prior to the Service;
    g. Premier Pressure Solutions will be advised of any works or activities that may interfere with the Services;
    h. The ongoing effectiveness of the Service depends on the Customer implementing maintenance recommendations, and failure to do so may reduce effectiveness;
    i. The Service is effective only for the period the treated area remains undisturbed;
    j. Any dissatisfaction with the Service must be reported within 24 hours of completion;
    k. To the fullest extent permitted by law, results may vary depending on surface condition, existing stains, prior treatments, or maintenance history.

  11. Premier Pressure Solutions may refuse to commence or continue the Service if it considers there is a health or safety risk.

  12. The Customer must not directly or indirectly solicit, engage or employ any employee, contractor or associate of Premier Pressure Solutions.

  13. Premier Pressure Solutions may recover from the Customer any loss or damage (including consequential loss) arising from a breach of this Agreement.

  14. Any quote or estimate provided is an estimate only. The final amount payable will be set out in the issued invoice.

  15. The Customer agrees to pay all invoices within the agreed payment terms.

  16. Additional services outside the original scope of work will be charged accordingly.

  17. If payment is not made in accordance with this Agreement, Premier Pressure Solutions may cancel the Service and charge a cancellation fee of 30% of the quoted or invoiced amount, which the Customer agrees is a genuine pre-estimate of loss.

  18. Interest may be charged on overdue amounts at the rate prescribed under the Supreme Court Act 1935 (WA).

  19. The Customer indemnifies Premier Pressure Solutions for all reasonable pre-legal and legal costs incurred in recovering unpaid amounts.

  20. To the fullest extent permitted by law, Premier Pressure Solutions provides only those conditions and warranties required by applicable legislation.

  21. To the fullest extent permitted by law, the total liability of Premier Pressure Solutions for any loss or damage (including negligence) is limited to either:
    a. Re-performing the Service; or
    b. Refunding the amount paid for the Service.

Warranty

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled:

  • to cancel your service contract with us; and

  • to a refund for the unused portion, or to compensation for its reduced value.

You are also entitled to choose a refund or replacement for major failures with goods. If a failure with the goods or a service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done you are entitled to a refund for the goods and to cancel the contract for the service and obtain a refund of any unused portion. You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the goods or service.
